Legal and safety framework

Public summaries of the Washington authorities reflected in CFV procedures and the Client Services Agreement.

Lower-level documents may add operational detail but cannot contradict a higher-level authority. CFV may pause service until written clarification is received. CFV has no duty to search a court docket for changes; clients must provide complete current orders and modifications.

When RCW 26.09.191 applies, no supervised visit occurs until the supervised parent and supervisor or designated program representative sign the current Supervised Visitation Acknowledgment and required copies are provided.

Protection commitment

The assigned supervisor must be willing and capable of protecting the child from physical or emotional abuse or harm.

Intervention

The supervisor may redirect behavior, separate participants, call for assistance, or end a visit when required by safety or the order.

No oral modification

Parents cannot orally waive an order. Even a joint request may require a signed agreed order or judicial clarification.

Title 110 WAC provisions and government-contract requirements may apply when a service is funded, ordered, or referred by DCYF or another public agency. They are applied only to the extent they govern the specific referral. Local court rules and judicial directives may add requirements.

Records and confidentiality

Records may include orders, scheduling, payments, communications, notes, incidents, reports, and authorized recordings. Confidentiality is not the same as attorney-client or therapist-patient privilege. Disclosure is limited to authorization, court order, subpoena, referral contract, or law.

Recording

CFV will not intentionally record a private service without legally required consent or another lawful basis. A separate recording authorization is required. Clients may not secretly record, screenshot, livestream, or use automated transcription.

Reporting and legal process

CFV and its personnel make reports when legally required and may make a good-faith report when authorized and reasonably necessary to protect a child. Valid subpoenas and other legal process are handled under applicable law and court rules.

Electronic signatures

Electronic records and signatures may have legal effect under Washington\'s Uniform Electronic Transactions Act. A portal acceptance record captures version, time, typed name, and security metadata, but case-specific agreements still require complete exhibits and CFV acceptance.

Data incident response

CFV maintains access controls, encrypted private-file storage, audit logs, and an incident-response process. Required notices are governed by RCW 19.255.010 and other applicable law.

Nondiscrimination and access

CFV applies uniform rates and lawful safety standards without unlawful discrimination and accepts requests for reasonable communication, disability, and access accommodations.
